White Mountain Apache Tribe I,_______________________________________, understand and acknowledge that participation in any wildlife and outdoor recreation activity, including but not limited to fishing, hunting, tour guides and river rafting or boating, or other such recreational activities (hereinafter "OUTDOOR ACTIVITIES") is a hazardous activity and involves risk of serous injury, including but not limited to, personal injury, permanent disability, death and property damage. I understand and acknowledge that these injuries and damages may result not only from my actions or negligence, but from the actions, negligence or fault of others. As a condition of being allowed to undertake OUTDOOR ACTIVITIES on the lands of the Fort Apache Indian Reservation (hereinafter referred to as "F.A.I.R.") as a holder of a permit issued by the White Mountain Apache Tribe (hereinafter referred to as "TRIBE"), I herby release the TRIBE and its contractors providing OUTDOOR ACTIVITIES, agents employees and insurers from any and all liability for damages, including but not limited to, personal injury, property damage and death to myself, including any and all other causes of action, damages, demand and claims whatsoever. I accept full responsibility for any and all injuries and damages of any kind whatsoever which may result directly or indirectly from my voluntary participation in outdoor activities which I choose to participate in on the F.A.I.R. This release of liability includes negligent acts or omissions or other fault of TRIBE or its contractors providing OUTDOOR ACTIVIES, including but not limited to, conditions on or about the F.A.I.R. and OUTDOOR ACTIVITIES facilities. I agree to indemnity, defend and hold harmless TRIBE and its contractors providing OUTDOOR ACTIVITIES from and against any and all liabilities, judgments, settlements, losses, costs or charges including reasonable attorneys' fees, incurred by TRIBE or its contractors as a result or any claim demand, lawsuit, arbitration or any other action relating to any bodily injury, death, property damages or other caused by, or arising out of, related to, or associated with my participation in OUTDOOR ACTIVIIES on the F.A.I.R. and applicable premises. I further agree to indemnify and hold harmless TRIBE and said contractors for any lawsuits or other claims for damages, including but not limited to, personal injuries, wrongful death and property damage sustained by me and agree to pay all costs and attorneys' fees associated with defending such lawsuit and claims. Because I understand the risks involved in OUTDOOR ACTIVITIES, I have carefully considered the adequacy of my insurance and personal financial resources which would be available to provide for myself and any other person who may be dependent upon me for support. By signing this release and by participating in OUTDOOR ACTIVITES, I affirm that I am properly insured or financially equipped to provide for any contingency which may arise as a result of my participation in OUTDOOR ACTIVITIES.
